Terms and Conditions of Sale
Art. 1 - DEFINITIONS
1.1) "Site": The website www.soluzionifonoisolanti.com, dedicated to the sale of acoustic products in general, owned by ACUSTICAITALIA SRLS. 1.2) "Customer": The entity (natural or legal person) who purchases from the Site, accepting the general terms and conditions of sale. 1.3) "Order": The purchase request form completed by the Customer through the Site. 1.4) "Products": Goods offered for sale on the Site under the general conditions of sale. 1.5) "Customized Products": Goods tailored according to the Customer's specific requests and instructions. 1.6) "Price": The payment for the goods, including a fixed cost for shipping, where applicable, as expressly indicated on the Site. 1.7) "Contract": The distance contract concerning the sale of Products under the general conditions of sale. 1.8) "Parties": ACUSTICAITALIA SRLS (Owner), and the Customer.
Art. 2 - SALE OF PRODUCTS
2.1) Products are sold in accordance with the terms and conditions published on the Site at the time of the Order.
2.2) The sale is deemed completed and binding for both Parties when the Customer confirms the Order through the designated electronic payment method, such as PayPal.
2.3) The creation of customized products by Acusticaitalia is subject to specific Customer requests, submitted via email to info@acusticaitaliapanel.com. For such products, the right of withdrawal is excluded, and a deposit of 30% may be forfeited.
2.4) Prices and products are subject to change without notice.
2.5) Incorrect purchases made by the Customer without specific consultation from Acusticaitalia are not refundable. However, a technical consultation will be offered to ensure the Customer receives the most suitable product. Acusticaitalia provides all necessary tools for this purpose.
Art. 3 - SUBJECT OF THE CONTRACT
The online sales contract refers to a distance contract for the sale of movable goods and/or services between the supplier, ACUSTICAITALIA, and a consumer Customer, using the internet as the sole means of communication. All contracts are concluded through the Customer's access to the relevant website and completion of the purchase process. By placing an order, the Customer confirms having read and accepted all related instructions and conditions. The Customer agrees to print or save a copy of these general conditions of sale.
The Customer is not entitled to compensation or damages for partial or total non-acceptance of an Order.
Art. 4 - DELIVERY TIMES AND METHODS
4.1) Product delivery to the address specified by the Customer is handled by courier (usually Bartolini).
4.2) Delivery times: 48 hours to 20 days for customized products within Italy; up to 40 business days for international orders. These times are indicative and not binding. Deliveries occur between 08:30 and 19:00. If the Customer is absent, additional delivery costs will be borne by the Customer. Products not delivered will be stored at the courier's warehouse, with storage fees possibly applied.
4.3) If some Products are unavailable after placing the Order, ACUSTICAITALIA may proceed with a partial delivery, which is considered valid.
4.4) Upon payment, ownership and transport risk pass to the Customer.
Art. 5 - CUSTOMER OBLIGATIONS
5.1) To purchase Products, the Customer must register on the Site, providing accurate and truthful information.
5.2) The Customer agrees to pay the Price and retain the purchase confirmation sent via email by ACUSTICAITALIA.
Art. 6 - PRICE AND PAYMENT
6.1) Prices are expressed in Euros, excluding VAT unless otherwise specified. Displayed prices are those listed on the ACUSTICAITALIA websites.
6.2) Final Order totals include VAT and any necessary shipping costs, but not customs duties or other international charges, which are the Customer's responsibility.
6.3) Payment is due upon product delivery (cash on delivery within Italy only), or in advance via credit card, PayPal, or bank transfer.
6.4) The purchase contract is concluded upon online confirmation.
6.5) The Customer may only purchase products available in the online catalog. Product images may differ from the actual items. Order confirmation is sent via email, including all order details and the Order Number.
6.6) The Customer may choose to collect the Products directly at the Acusticaitalia facility. In that case, no shipping fee applies. The Customer may modify or cancel the order within 24 hours of receiving the production confirmation email. Otherwise, payment is due in full.
6.6 - Penalty: If the order is not collected or honored after the allowed period, the Customer must pay 50% of the invoice.
Art. 7 - FORCE MAJEURE
7.1) Neither Party is liable for delays caused by events beyond their control. The affected Party is entitled to an extension.
7.2) ACUSTICAITALIA is not liable for fraudulent use of credit cards or payment methods during purchase, as payment data is transmitted securely to third-party processors (e.g., PayPal).
Art. 8 - COPYRIGHT & TRADEMARKS
8.1) Trademarks and logos on the Site belong to their respective owners.
8.2) Unauthorized use or reproduction of such trademarks is prohibited.
8.3) Website content (texts, graphics, animations, images) is protected by copyright.
Art. 9 - RIGHT OF WITHDRAWAL
9.1) As per Legislative Decree 185/1999 and 50/1992, Customers may withdraw from the Contract and request a refund.
9.2) This right applies only to consumers (private individuals using a fiscal code). Businesses and VAT-registered entities are excluded.
9.3) Withdrawal requests must be sent via registered mail with return receipt within 15 business days to: ACUSTICAITALIA SRLS, Via di Torre Santa Anastasia, 61 - 00134 Rome, Italy.
9.4) Returned Products must be in good condition, with original labels and packaging.
9.5) Refunds or replacements occur within approximately 40 days of receipt and inspection.
9.6) Shipping costs are non-refundable.
9.7) Customers must first request a Return Authorization via email: info@acusticaitaliapanel.com
9.8) Upon inspection, if products show damage or missing parts, the right of withdrawal is voided.
Art. 10 - PRIVACY
10.1) Customer data is processed in accordance with Legislative Decree 196/2003 on Personal Data Protection. Data is used solely to fulfill Customer requests and is never shared with third parties.
Art. 11 - ENTIRE AGREEMENT
11.1) The Contract supersedes all prior agreements between the Parties.
11.2) Any modifications must be in writing and accepted by both Parties.
Art. 12 - COMMUNICATIONS
12.1) Communications between the Parties must be in writing, either via physical mail or email.
12.2) Any legal communications must be sent by registered mail with acknowledgment of receipt.
Art. 13 - LANGUAGE
13.1) The sales contract is written in Italian.
Art. 14 - GOVERNING LAW AND JURISDICTION
14.1) The Contract is governed by Italian law.
14.2) The United Nations Convention on Contracts for the International Sale of Goods does not apply.
14.3) Jurisdiction lies with:
a) The Customer's local court, if a consumer;
b) Exclusively the Court of Milan, Italy, in all other cases.
Art. 15 - WARRANTY
15.1) Acusticaitalia provides a minimum 12 to 24-month warranty on its products. 15.2) The 24-month warranty covers defects of conformity for private Consumers only, provided the product is used correctly as per its documentation.
